A Dutch divorce can be arranged almost entirely at a distance: the petition is filed digitally by your lawyer, the terms are negotiated and signed by video and email, and in an uncontested joint petition the court decides on the papers without either spouse appearing. The one thing that stays the same is the substance of the case, not just the form.

Working remotely changes how the process runs, not what it requires. The same documents have to be produced, the same arrangements agreed, and the same court decides, whether the case is conducted from Eindhoven ወይም ከውጭ አገር።

What can be handled remotely?

The intake, the exchange of financial information, and the drafting and negotiation of the divorce covenant (echtscheidingsconvenant) and the parenting plan (ouderschapsplan) can all be done without meeting in person. Where a court hearing is needed, some courts allow it by video link, though whether that is offered is for the court to decide.

Documents can be signed electronically. For a covenant and a parenting plan, which are private agreements rather than notarial deeds, an electronic signature through an established platform is normally accepted and gives a clearer record than a scanned wet signature.

What still needs extra care?

Three points deserve attention when a divorce is arranged at a distance. Identification: your lawyer has to verify who you are, usually with a valid identity document and a video call. Financial disclosure: this is where remote divorces most often go wrong, so pension statements, mortgage documents and property valuations still have to be produced and checked, not simply summarised by one party.

The third is the children. A parenting plan drawn up at a distance needs to be more detailed rather than less, because the parents will not be sitting at the same table to iron out what was left vague.

When is a remote divorce not the right approach?

Where there is a serious imbalance between the parties, where one spouse does not have a clear picture of the finances, or where there has been pressure or abuse, handling everything remotely through a single lawyer is not appropriate. In those situations, each party needs its own adviser and at least some contact in person.

What changes when one spouse lives abroad?

Two questions come before anything else: whether the Dutch court has jurisdiction, and which country’s law applies to the divorce and to its financial consequences. The two answers can differ, and together they decide where it is best to file. We resolve both before a petition is lodged, not after.

Why does registration still matter?

However the case is handled, the divorce only takes effect once it is recorded in the register of civil status (burgerlijke stand), and that has to happen within six months of the court’s decision becoming final. Couples who have arranged everything remotely are the ones most likely to overlook this final step, since there is no in-person appointment to prompt it.

በማጠቃለያው

  • A Dutch divorce can be arranged almost entirely online, but the legal requirements are the same as for an in-person case.
  • Identification, financial disclosure and a detailed parenting plan need more attention at a distance, not less.
  • A serious imbalance between the parties, unclear finances, or pressure or abuse means a remote, single-lawyer process is not suitable.
  • When a spouse lives abroad, jurisdiction and applicable law should be settled before the petition is filed.
  • The divorce is only final once it is registered in the register of civil status, within six months of the decision.

Can we get divorced online if we agree on everything?

Yes. If you and your spouse agree on the divorce and its consequences, the petition can usually be handled as an uncontested joint request, decided by the court on the papers.

Do we need to visit the Netherlands to divorce remotely?

Not necessarily, but your lawyer still needs to verify your identity, and the court may ask for a hearing depending on the circumstances of the case.
